(130,974 posts)'Defense counsel failed to file the brief as ordered. On the hearing date, neither defense counsel nor defendant appeared. The judge noted that defense counsel had faxed a request for another adjournment very late the previous day. The letter is not included in the record. The State objected to any further adjournments. The judge then dismissed the appeal for lack of prosecution. The court also stated the ex post facto argument lacked merit and "[w]ere [defendant] here to prosecute the matter, I would dismiss it substantively on the merits." The court entered an order dismissing the appeal "[s]ubstantively on the merits and [f]or failure to prosecute."
Defendant did not move to reinstate the municipal appeal. Instead, new counsel for defendant filed a notice of appeal on September 28, 2011. We dismissed that appeal for failure to prosecute in February 2013, but granted a motion to reinstate in April.'
Thanks for the info. Gives insight into his and his family's life here (in NJ.) Wonder why he did his deed in NYC.

MANY places/towns thrive with influx of people with such religion (and cultures,) and their restaurants contribute significantly. If just a chicken place maybe not as great as others, but lots of small Indian/Pakistani places thrive in my area.

This dude is a terrorist, and an Islamic extremist.
Some terrorists are also homegrown white neo-Nazis and right wing extremists, sure.
And many people who crow when another Islamic extremist launches another terrorist attack are racist shitheads, including very close to (our Internet) home. Absolutely. A good deal of them are, in fact: they love guns, hate black folks, and throw a damn party every time one of these Islamist assholes shoots or bombs something.
NEVERTHELESS: some of these terrorists are Islamic extremists and they really, truly are trying to kill you.
The Left needs to wrap its head around this. It's not a media game. It's quite real.

(14,918 posts)..."Ahmad Khan Rahami, the man wanted in the bombing, is the son of a man named Muhammad Rahami who runs a fast-food restaurant, First American Fried Chicken, in the ground floor of their home on Elmora Avenue, neighbors said.
The restaurant, which has employed Ahmad and some of his brothers, was such a persistent neighborhood nuisance that the city forced it to close early, said Mayor J. Christian Bollwage of Elizabeth.
When it was opened several years ago, it stayed open all night, Mr. Bollwage said.
Neighbors, including Dean McDermott, who lives on the corner of Linden and Elmora Avenues and works as a news videographer, said the restaurant drew rowdy crowds past midnight.
Often Mr. McDermott found patrons loitering in his yard and urinating in his driveway, and he called the police. Others did, too."....(more at link)
'It was neighbor complaints, it had nothing to do with his ethnicity or religion, the mayor said. It had to do with noise and people congregating on the streets.
Mr. McDermott said that the Rahami family and the community came to an uneasy truce. The restaurant wouldnt close at 10 p.m., but police stopped hassling them, and they would close at midnight or 1 a.m.'
