Cop dies during 3-way sex; widow wins $3M lawsuit

from the USA Today, via the Detroit Free Press:

A jury has awarded a Georgia woman $3 million over her husband's heart attack, finding that his doctor should have warned the Atlanta cop against strenuous activity like the three-way sex he was having at the time he died, WXIA-TV reports.

William Martinez, a 31-year-old Atlanta police officer, collapsed and died while he and a male friend were having sex with a woman who was not his wife at an Atlanta airport motel in 2009.

The jury on Friday found that Dr. Sreenivasulu Gangasani and the Cardiovascular Group were 60% to blame for Martinez's death from atheroschlerotic coronary artery disease, agreeing with the plaintiff that the doctor did not properly diagnose and treat Martinez for high blood pressure, chest pains, shortness of breath and irregular heartbeat. ................(more)

My guess is that the appeals process will drop the dollar amount considerably.

Yes, he should have been warned that he was a ticking time bomb. However, it would likely not have stopped him from high risk sex behavior.

If he was 40% responsible for his own death, th award should only be $2 million, not $3 million. Or am I lookiing at this wrong?

though the failure to warn makes for a more sensationalistic story, hence its mention in the lead paragraph, while the failure to properly diagnose and treat requires further reading....

If the doctor misdiagnosed him then the doctor misdiagnosed him.

End of salacious story.

but he's not my doctor. In fact, I was there this morning for a routine follow-up with my regular cardiologist before mitral valve & septal myectomy surgery scheduled for Friday.

I've been going to this practice for more than 4 years -- never had any problems getting appointments or tests. If only getting sex (even two-way) were so easy.

I would think no, since you get a break now and then while the other two play!

still get the dough? Better yet, what if someone threw him a surprise birthday party and he got so excited that it was his last? This story deserves more popcorn that it has..... would the settlement be less if it was only a two way, or worse yet, a ONE WAY??
