PORTLAND, Ore. (AP) ... U.S. District Court Judge Robert E. Jones said Wednesday he remained concerned about David Fry's mental instability and threats of "suicide by cop" before his surrender to FBI agents.
Jones also said a psychological report on Fry states that Fry is concerned about invasions from outer space and has spoken of a wish to be reincarnated as a woman ...
A federal judge in Eugene found Medenbach guilty in April of illegally camping on federal public land in Josephine County last year.
Medenbach has pleaded not guilty to conspiracy charges in the Malheur County case. He was arrested Jan. 15 in the parking lot of a Burns Safeway in a pickup truck with federal government license plates. He has said in court he only borrowed the truck to pick up groceries ...

... He argued that he's never been diagnosed with a particular mental illness, that he has the right to believe in what he chooses to believe in, and that yes, he had said he'd rather be a woman "because it seems easier.'' The suicidal statements he made before his surrender at the refuge came because he was fearful of being raped in jail, he told the judge.

Jones said he was concerned that Fry was walking around the refuge with a gun, when he has had a prior commitment to a mental hospital. Fry had broken down a door and escaped from a mental hospital about four to five years ago ...

I listened to their last night at the refuge. Fry didn't seem too stable then, but I figured it was a combination of the loneliness of the refuge, and fear of the unknown. The judge is right about not releasing him because if he is unstable there is no telling what he might do ... the judge would be blamed if it was something horrific.
I was reading last week that the Bundys want to delay their trial. This after they insisted on a speedy trial. Glad the judge denied their motion.
