She is being forced to record 6 more albums with a producer who RAPED her when she was 18.
The judge said "Sony would suffer irreparable harm" if she didn't produce six more records! What a bunch of crap! She hasn't done shit for them so far have they gone under????

(6,342 posts)And she really provided no evidence of the rape/abuse. I'm not saying she is lying. But its kind of hard for a court to really consider that as part of a judgement when she doesn't provide any evidence of it. She also didn't make the allegations until it was clear she wanted out of the contract.
Sony has also offered to have her work with a different producer and production team.
That all being said, artists these days basically sign their soul over to these record companies when they sign these contracts. The record companies ruthlessly control the industry and are a very resistant to change.

on the evidence actually before the court. Moreover, this proceeding only involved a request for an injunction. The standards are very high to obtain such preliminary relief, particularity where such relief effectively provides almost everything Kesha has demanded in her lawsuit.
Kesha will still be able to litigate the entirety of her claims. However, based on the court's comments and analysis of the pleadings on defendants' separate motion to dismiss, Kesha's case appears quite weak.
This matter has been in the news for quite some time. There is a great deal of evidence that Kesha's claims about sexual improprieties by her then producer, claims that were never reported to the criminal authorities, were mere pretense or subterfuge as a means of getting out of her long-term, financially disadvantageous contract.
In any event, Sony has repeatedly made clear Kesha need no longer work with Dr. Luke, and vague and unsubstantiated fears that Sony will not promote her albums if she doesn't work with him, actions against Sony's own commercial interests, had no real chance of supporting her claims for injunctive relief.
Note I'm a commercial litigation attorney in NYC, but have no connection whatsoever to this case.

(15,429 posts)It simply is not a factor in ejudicating contract law unless there is a specific clause that would invalidate the contract under such circumstances.
Be careful what you sign and understand all obligations and especially understand what it takes to invalidate your obligations under the contract.

No, I simply understand that without any actual evidence to support her claims, Kesha's obligations under her voluntary contract will not be abrogated by the court, and certainly not through injunctive relief.
Kesha bears the burden of proving her allegations through admissible evidence in order to win her lawsuit, and no court will effectively provide her with all the relief she seeks without so much as a formal, investigated criminal complaint against her former producer.
What is disgusting is your presumption of the producer's guilt without supporting evidence, hardly a liberal position, to say nothing of your ignorance of the most basic fundamentals of contract law.
Spare me the self-righteous preening and hashtag activism, and try actually dealing with the merits of Kesha's lawsuit.
