If the GOP Senate were smart

they would say Obama can name a recess appointed justice. That would make them look reasonable and make the election about the court. Not sure if they would ever do this.

A justice must be around for the full term, hearing arguments and then issuing their rulings.

that would let this term be finished and the next term could be structured to have votes on the cases they hear before Jan.

That would waste part of a term.
