2. President Obama will fill it with a strong pro corporatist judge with some token civil rights cred.

The Republicans will accept it because it is exactly what they want, and a pretty good deal considering the likelihood that Bernie will be the next President. Cause Bernie don't play dat.

He could see if Sandra Day O'Connor is interested in rejoining.

She'd be a significant improvement over Scalia, though tbh pretty much anyone would be a improvement over him. It'd put Republicans in quite a bind as well, given that she originally was a Reagan appointee as well. (Even moreso for the Teapublicans, given their higher worship for Reagan) Everything would be even funnier too since they'd no doubt attack him over appointing three women to the Supreme Court.

They know the Dems are at war with one another over electablity. The salient point is Supreme Court appointments. It's being framed as, "We have to have a Dem in office, and _______ is more electable."

The Rs are likely thinking that Hillary will be our next POTUS. Taking away a 3rd justice from Obama, not as big a deal as knee capping Hillary's presidency from Day 1. Hillary will not be able to accomplish the singular most important task she was elected to do: appoint a liberal (minority, woman, etc..) SC Justice. So much for being effective, getting things done, and proving she can work with Rs. If it's Hillary, the Rs will pick the next justice.

because if we work hard enough Bernie is the next president. All his polling against potential republicans shows that he has the edge in the general.
