My American flag will not be lowered to half staff.
Not for that man.

(22,037 posts)The late Supreme Court Justice Scalia was a terrible blight on the civil rights of Americans and I do not mourn his passing.
However, it's against an unenforceable law to violate the Flag Code. This is from Wikipedia:
"The United States Flag Code establishes advisory rules for display and care of the national flag of the United States of America. It is Chapter 1 of Title 4 of the United States Code (4 U.S.C. § 1 et seq). This is a U.S. federal law, but the penalty described in Federal Law 18 USC Section 700[1] for failure to comply with it is not enforced. The U.S. Supreme Court ruled in United States v. Eichman that prohibiting desecration of the U.S. flag conflicts with the First Amendment right to freedom of speech and is therefore unconstitutional.

- The U.S. flag is otherwise flown at half-staff (or half-mast on ships) only when directed by the President of the United States, or (only for buildings within his or her jurisdiction,) the Mayor of Washington, D.C.

Since I don't fly the flag outside my home, this isn't really an issue for me but I'll stand with you, anyway, good Cows!

(15,317 posts)only when directed by the President. You left off the "only", there. It doesn't say anything about leaving it up when the President directs a half staff for a non-President. The flag is generally only supposed to be lowered when a President or former President dies. So, is it desecrating the flag if a President orders it for a non-President and one doesn't lower it? This doesn't address that.
