scalia's worst position?
the list of horrible positions and opinions scalia has handed down is long, and i'll leave that list to others.
for me, the single most telling of his positions was is view that the death penalty was acceptable even when applied to defendant known at the time of execution to be innocent.
it's one thing to support the death penalty knowing that the people and processes involved aren't perfect and sometimes, someone who turns out to be innocent is put to death.
but scalia took it to another level entirely when he insisted that anyone who has been convicted and sentenced to death should be put to death, if they received a fair trial that just happened to reach the wrong conclusion and exhausted all appeals, EVEN IF they were later proved to be innocent (via witnesses recanting, other witnesses coming forward, dna evidence, or other previously unavailable information).
it takes a very special sort of person to be able to go to an execution, look the victim in the eye and say, "i know you are innocent, but the right thing is for the state to kill you. i could stop it, but that would be wrong."
i believe the technical term would be sociopath.
