Obama could make a recess appointment between the sessions of Congress in January

Not very likely to happen IMO, but an interesting hypothetical.

If Republicans refuse him a vote on his nominee, Obama could make a recess appointment with just a few weeks left in his term. Republicans can avoid recess appointments during normal breaks and vacations with pro-forma sessions. But there will be a brief time between congresses that he could act, when the 114th Congress expires and prior to the 115th being gaveled in.

If I understand correctly, this person could serve on the Supreme Court through the end of 2017, or until the Senate confirms a successor, whichever comes first.
