(1,178 posts)Will he have the strength to not only appoint a successor, but to continually and publicly call out the Republicans for refusing to hold a vote? Will the Democratic Party announce that if the Republicans refuse to confirm an appointee now, they will do exactly the same thing for all Republican nominees for all positions if a Republican wins the Presidency? Will Obama use his executive authority to cut federal funds (as in military bases) in states that obstruct him? Or, will he capitulate?
What do you think?

As to if things were on the other foot..... IF we get a Dem Socialist, the GOP will be hitting themselves over the head. IF we get a Dem, we'll get bend-over-backwards compromizing to show how great we are.
Obama did just say he would appoint someone. Ok, so will he do what he has done throughout his presidency and start the process by negotiating against himself by appointing a relatively conservative judge? Or, has he finally learned the lesson that there is no compromising with the Republicans and nominate someone who best represents the people of this country and publicly fight for his candidate? Personally, I think he's going to do the former, but I would love to be surprised!

(11,564 posts)My only exposure to him has been in text form, so I don't know how personable he is, but I still maintain he might well have been a great replacement for Jon Stewart. Based on my rather one-dimensional assessment of him notwithstanding.

It's on regular radio, but if your area doesn't have that, get SiriusXM.

(23,105 posts)Scalia didn't give a damn about the constitution, he totally gutted it when he voted to put the unelected Bush in office and will burn baby burn for that and Citizens United plus his ruling that turned the 2nd amendment on it's head. He was the anti-constitutionialist. He even said that his beliefs about the bible should over-ride the constitution.
Repugs are such bizzarros, everything they say means exactly the opposite.

(17,202 posts)That would be 16 Stat 44, aka The Judiciary Act of 1869, and the Circuit Judges Act of 1869.
The important part, factually, is that as a statute it is susceptible of change by the legislature. So opposing filling the vacancy has nothing to do with regard for the Constitution, which is appropriate, since Mr Justice Scalia had no regard for the Constitution.
