FLINT, MI -- Former Flint emergency manager Darnell Earley has been taken off the witness list for a Congressional hearing Wednesday, Feb. 3, and replaced by a resident who helped bring attention to shockingly high lead levels in some Flint homes.
Earley, who is refusing to testify on the city's water crisis, is leaving his position as Detroit Public Schools emergency manager Feb. 29, Gov. Rick Snyder's office announced today, Feb. 2.
He told the House Committee on Oversight and Government Reform that he will not testify about how the Flint water crisis unfolded even though he was invited as one of five witnesses.
Earley served as emergency manager as Flint changed its water source from Lake Huron water, treated by the city of Detroit, to the Flint River in April 2014.

(1,683 posts)but his lawyer probably told staffers he would just take the Fifth on every question. Unless you want a show of him sitting there taking the Fifth, you just pass on to the next witness. That is the problem with hearings which may involve criminal indictments, the witnesses can repeatedly take the Fifth.
Congress could "immunize" him in the hopes of getting bigger fish, but that is risky. If you fully immunize him, you run the risk of him testifying that everything was his fault. An example was Iran-Contra where they immunized Admiral Poindexter expecting to get Reagan. Poindexter then testified that it was all done on his personal direction and responsibility. Seeing the faces on the committee, it was just like all of the air being let out of a balloon.

(19,993 posts)What did GOP politicians in D.C. know about the Flint water problem and when did they know it? Did Snyder & Co. receive any assurances from the national GOP not to worry, they'd have their back? Snyder & Co. should all be subpoened and maybe some Republicans in Congress as well.
