Anderson, 47, and his wife, Sandy, 48, remain encamped at the Oregon wildlife refuge with Jeff Banta, 46, of Elko, Nevada, and David Fry, 27, of Blanchester, Ohio. "I'm hoping for a miracle," Anderson told Sheriff Doug Giddings, who has been Idaho County's top law enforcement officer for eight years. "I believe God put us here." ......

1666. Destruction Of Government Property -- 18 U.S.C. § 1361[/center]


Section 1361 protects "any property" of the United States or an agency or department thereof, or any property being manufactured or constructed for the United States or an agency or department thereof, from willful depredation or attempted depredation. "Depredation" has been characterized as the act of plundering, robbing, pillaging or laying waste. United States v. Jenkins, 554 F.2d 783, 786 (6th Cir. 1977); cf. Deal v. United States, 274 U.S. 277, 283 (1927) ("depredation" defined in context of postal statute). This section prohibits actual physical damage or destruction of both real and personal property, but mere adverse possession of that property without physical harm is insufficient to violate the law. United States v. Jenkins, supra, 554 F.2d at 785. Section 1361 is a specific intent crime, see United States v. Jones, 607 F.2d 269, 273-74 (9th Cir. 1979), cert. denied, 444 U.S. 1085 (1980), and the government must prove that the defendant acted willfully; that is intentionally, with knowledge that he/she is violating a law. United States v. Simpson, 460 F.2d 515, 518 (9th Cir. 1972); United States v. Moylan, 417 F.2d 1002, 1004 (4th Cir. 1969), cert. denied, 397 U.S. 910 (1970). The government is not required to prove that defendant knew the property belonged to the government, because government ownership is "merely a 'jurisdictional fact'." United States v. LaPorta, 46 F.3d 152, 158 (2d Cir. 1994), quoting United States v. Feola, 420 U.S. 671 (1975). In fact, title or possession by the United States is not a necessary element of this offense, if the property in question was being made for the United States. The government must present evidence establishing value of damage. United States v. Seaman, 18 F.3d 649, 651 (9th Cir. 1994). The penalties for violations of this section are tied to the extent of the property damage. As amended on September 13, 1994, if the damage exceeds $100, the defendant is subject to a fine of up to $250,000, ten years imprisonment, or both. See Violent Crime Control and Law Enforcement Act of 1994, Pub. L. 103-322, § 330016, 108 Stat. 1796, 2146-47 (1994). When property damage does not exceed $100, the offense is a misdemeanor punishable by a fine of up to $100,000, one year imprisonment, or both. See 18 U.S.C. §§ 3559(a), 3571.

.... the novel, Only by Blood and Suffering: Regaining Lost Freedom, isn’t quite as completely unreadable as we’d anticipated. It’s merely tedious, badly written, laughably preachy, and composed of militia propaganda standing in for dialogue, with some pretty cheesy action sequences thrown in to hold the whole mess together. It’s a bit like somebody read a lot of Red Dawn fanfiction while visiting Alex Jones’s Infowars website. How bad is this book? It’s so deliciously bad that we’re going to make this review a two-parter, because there’s simply so much wonderful idiocy in it we’d feel remiss if we didn’t share as much as possible with you Wonkers.

The plot, such as it is, follows the travails of the Bonham family, whose patriarch, a flinty old cowboy named Jake, lives on a ranch in southern Utah, near the conveniently-named real town of Orderville. .......

Landowners Inside FBI Perimeter: 'We’re Psychologically Exhausted'

Andy and Vena Dunbar have spent the past six days living within a no man’s land inside the FBI checkpoints that now surround the Malheur National Wildlife Refuge headquarters.

“We’re psychologically exhausted,” Andy Dunbar said. “For most of this week we’ve felt that we haven’t been getting any support. We’ve basically felt like we’ve needed to protect ourselves.”

Their 400-acre ranch is directly adjacent to the refuge, which puts them closer to the four remaining armed militants than to law enforcement.

Call To Action: The Pacific Patriots Network has organized a protest of the “violent, malicious and deceitful tactics” of law enforcement in relation to the occupation. In a press release issued Friday, the PPN called on “any and all Americans” to come to Burns, Oregon, for what they have described as a peaceful protest. The group said it plans to demand that the FBI leave Harney County, that Sheriff David Ward and Judge Steve Grasty resign, and that the FBI special agent in charge, Greg Bretzing, be detained during the ongoing investigation into the shooting death of Robert LaVoy Finicum.

Nevada rancher Cliven Bundy said Monday that the occupation at the Malheur National Wildlife Refuge would continue.

In a notarized letter from Clark County, Nevada, Bundy wrote to Harney County Sheriff David Ward that “We the People of Harney County and also We the People of the citizens of the United States DO GIVE NOTICE THAT WE WILL RETAIN POSSESSION OF THE HARNEY COUNTY RESOURCE CENTER. (Malhaur [sic] National Wildlife Refuge).”

The letter was also sent by certified mail to Oregon Gov. Kate Brown and President Barack Obama.

“Remove all federal and state policing agents out of Harney County,” Bundy wrote. “Place a Harney County sheriff guard post at the entrance road of the Harney County Resource Center stopping all from entering or exiting, for a time.” ....

Hundreds of people gathered Monday at the Harney County Courthouse to voice their frustrations, but the demonstrators didn't share the same anger. One faction backed the standoff, the other wanted it over. Yet both sides had staying power, with neither wanting to leave first. The dueling protests lasted about four hours at full throttle, dwindling only in the fifth hour to a handful of people.

so, what i haven't been telling y'all is for the past 36 hours i've been in communication with the militants at the refuge 1/5
i've called every four hours -- most of these conversations have been short. 2/5
the FBI was concerned about the militants poisoning themselves because they were sleeping in their cars with their engines on 3/5
they're not doing that anymore -- they're also not talking with anyone. I was called about fifteen minutes ago by an unknown number 4/5
and told that as of 12:50, there would be no more external communications -- meaning i can't call in. I was not able to reach them at 1:30.

As the armed occupation in Oregon’s high desert unfolded in January, it initially looked like little more than a widescreen version of the flare-ups we’ve seen in the West ever since the Sagebrush Rebellion erupted in the 1970s: “oppressed ranchers,” anti-federal rhetoric, and even stoic cowboy-hatted heroes to ride to the rescue. But a closer look — and the occupation’s violent culmination — revealed a bigger, more sinister problem than your run-of-the-mill local-control scuffle.

For starters, precious few locals (or even ranchers) were among the couple dozen occupiers of the Oregon’s Malheur National Wildlife Refuge. The lead occupier, Ammon Bundy, may look the part, but he actually owns a truck-fleet maintenance business in Phoenix and a McMansion in Emmett, Idaho. At one of his press conferences, Bundy said that he wasn’t just sticking up for “the ranchers, the loggers and the farmers,” but also the “auto industry, the health-care industry and financial advisors.” That remark, which ignored the federal largesse those industries receive, revealed the crusade’s true scope.

Whereas the Sagebrush Rebellion of old was driven largely by pragmatic, grassroots concerns, today’s version is purely ideological — a nationwide confluence of right-wing and libertarian extremists. Many of them have little interest in grazing allotments, mining laws or the Wilderness Act. It’s what these things symbolize that matters: A tyrannical federal government activists can denounce, defy and perhaps even engage in battle with. This movement, which has grown increasingly virulent since President Barack Obama’s election, has created a stew of ideologically similar groups, ready to coalesce around each other when necessary.

As we head into an election year, it’s worth noting that many of the extreme actions carried out by fringe groups, such as the Malheur occupation, inspire other hard-core ideologues and ultimately translate into votes for like-minded politicians. In return, those politicians support the extremists and try to push their views .......

The new lighted sign changes from “Road Closed” to “No Unlawful Entry” to “Subject To Arrest.”

It’s the latest indication that the coalition of law enforcement guarding the Malheur National Wildlife Refuge have no interest in additional militia members, media or curious members of the public getting within five miles of the headquarters.

Reporters looking into the closed-off area from a nearby hill could observe what looked like multiple roadblocks along the road to the refuge headquarters. There was no obvious sign of the four people believed to be mostly camping within the refuge. The only movement to or from the headquarters appeared to be law enforcement vehicles.

A wilted rose and scattered leaves lay next to it, and a piece of broken lumber sat just behind it. A pocket New Testament was propped against the remains of the cross, next to a patch of the American flag. A horseshoe lay in the dirty snow. ... The Oregonian really downplays the crazy, almost as if they are cheering the standoff. Their bias is obvious if you pay attention to what they leave out, like Fry calling the crazies to arms. The headline is Fry told FBI fuck you and told fellow Americans they were the enemy. Oh, and, most importantly, he wants to "get rid of" enemies and he has guns. Those details matter, that's the part we "need to know" most. The Oregonian is not where to go for the straight facts!

● A Malheur National Wildlife Refuge protester was arrested Monday on a warrant from Kansas.

● Ammon Bundy's lawyers deny claims that they violated any ethics laws as two complaints were filed Monday with the Oregon State Bar against their Eugene law firm. Bundy ended up hiring Arnold Law Firm less than three weeks after its lawyers went to the occupied Malheur National Wildlife Refuge to offer their services for free. The state bar says a lawyer shall not solicit professional employment ..............
