Council Bluffs Police Officer Ben Lake and former attempted murder suspect Adam Thomas both received some good news from Pottawattamie County Attorney Matthew Wilber.
At a press conference Tuesday at Council Bluffs City Hall, Wilber said his office will not be charging Lake with any crimes resulting from the officer firing six shots at Thomas as the suspect escaped arrest on Oct. 14 at Bomgaars. Likewise, two charges against Thomas have been dropped.
Wilber said Lake, a four-year veteran, had probable cause to fire his weapon.
Around 4 p.m. on Oct. 14, Lake arrested Thomas for trying to return $120 worth of merchandise that did not belong to him to Bomgaars. Wilber said that Lake did not roll a rear window up in his Chevrolet Tahoe police cruiser, so Thomas was able to free his right hand from handcuffs, reach through the opened window and open the cruiser.
