It seems that study Scalia cited was deeply flawed.

When Supreme Court Justice Antonin Scalia suggested that African American students might be genetically inferior to their white peers and did not belong at rigorous schools, but "lesser schools", he cited cited an amicus brief, by UCLA law professor Richard Sander in 2004. Sander's work is often referenced by those trying to abolish affirmative action.

May it please the court… there was another brief that was filed that points out all the FLAWS in the brief that Scalia uses to make his points. Scalia ignored the one that pointed out the study he likes was actually debunked:


"But that “growing volume of very careful research” consists mostly of Sander’s own “mismatch” research along with unpublished papers by several others. As recognized by numerous publications refuting Sander’s conclusions, that esearch contains basic methodological errors, thereby invalidating its conclusions. As a result, its conclusions are without value to the Court."


He held the same view in the past, equating voting rights as a "racial entitlement". Yeah, this racist sits on the highest court in the land.
