Medical Marijuana q: plane travel state to state

Let's say a person who is registered as a med marijuana patient in State A is traveling to State B for a month. State B, like State A, is a mmj state but as a resident of A, the patient can't get mmj in B.

Is the patient from A allowed to take his mmj with him on a plane to B, since he can't get it in B and it's a prescribed legal medicine? If it's found by say, TSA in the luggage, and the patient has the registration and is totally legal in State A, can the patient be held up by authorities for attempting to cross state lines with mmj?

OK, let's hear from all you legal beagles. This would make an interesting test case for mmj patients crossing state lines.

I'm pretty sure you can't legally take it across state lines under any circumstances.

You're in federal jurisdiction as soon as you enter the airport. Marijuana is illegal period under federal law, even before you transfer it between states.

I drive a lot.

We are truly living in a police state. If TSA ever arrested my senior friend b/c she has some legally prescribed mmj capsules in her bags, and not thousands of caps, but enough to last her alone for her one-month trip, I would be so upset---not just about my friend, but about what this country IS.

Dear wordpix,

Thank you for your message concerning medical marijuana and air travel. We must tell you that flying with marijuana, even lawfully recommended and obtained medical marijuana, is a federal crime and will result in your arrest and prosecution if caught. Though individual states can and have legalized medical marijuana, air travel is regulated by the federal government, and thus federal laws—including marijuana prohibition—rigidly apply.

Our advice is to simply not take the marijuana on a plane. We agree this is onerous and unfair to suffering patients, but until federal law changes there is not much that can be done. MPP hates to see anyone arrested for marijuana possession, and we do not wish to see a senior with stage 4 cancer join the ranks.

Thank you again for your message. We sincerely wish your friend the best for her continued health management.

if they find cannabis, they will alert authorities at both the departure location and at the destination. if neither has a problem with a small amount you will likely be OK. the thing is, most airports in places where cannabis is legal, are banning possession within the airports themselves, regardless what the legality is outside the airport. here in Colorado, the major airports have amnesty boxes, where they will instruct you to put your pot, if found.

ETA: It is rare for states to honor other state's MMJ cards. to be truly legal, a med user would have to have a card in both states.

makes an argument for traveling by rail, which is more fun anyway.

If you are reckless and rich, go ahead and try it. I'd love to see this issue show up in the courts.

She is the perfect person to sue, too. Well educated, articulate, senior, petite, friendly, smart, Dem. Oh well, she can't afford to sue the fed gov. Now if there were backers...
