In 2004, this wouldn't have been considered rape in Tennessee, since they weren't separated, didn't inflict broken bones or ruptured organs, and didn't involve a weapon.
So, yes, when this kid grew up, men were allowed, if not encouraged, to rape their wives by the state of Tennessee.
The cultural backwardness unpinning such a legal system won't go away so shortly.
Not that the rest of the US was much better--every state in the union allowed, if not encouraged, men to rape their wives until 1976, when Nebraska became the first state to make it illegal.

Many of the other states that differentiate between rape and marital rape do so through language similar to Ohios force or threat of force requirement but South Carolina state code goes so far as to require the threat of use of a weapon and/or physical violence of a high and aggravated nature in order to prosecute what it terms spousal sexual battery.
By comparison, South Carolina only requires force or coercion, aggravated coercion, and, at most, aggravated force to prosecute various degrees of criminal sexual misconduct when the victim is either not a spouse or a separated spouseno mention of weapons and no requirement of elevated level of violence.

is correct a lot more than it's incorrect--marital rape is the single most unprosecuted crime in the country.
