WTF? The Kim Davis Same-Sex Marriage Saga Continues - altering forms and information

WTF, she must think she's been anointed "Queen of the Courts." IMO this is getting totally ridiculous! None should have to go through this nonsense. She talks about her rights, what about the rights of those just wanting a legal marriage license in their own county where they live and to get on with their lives.

On Friday, an attorney for one of Davis’s employees said in a court filing that Davis has violated federal court orders once again.

The filing says Davis has been altering marriage license forms in a way that effectively takes her name out of equation altogether, and can potentially weaken their validity. Given this news, ACLU attorneys—working for several gay couples who sued Davis for her refusal to issue marriage licenses—are currently “exploring legal options,” the New York Daily News reported, citing another Friday court filing.


Almost immediately upon returning to her post, Davis apparently began to alter marriage forms by taking her name off the forms and having Brian Mason, a deputy clerk, initial them, allowing the forms to be notarized. Richard Hughes, Mason’s attorney, filed a report on Friday saying that Davis made changes “in some attempt to circumvent the court’s orders and may have raised to the level of interference against the court’s orders.”

obnoxious, certainly, but, i think, technically legal, depending on exactly how the deputy clerks are filling out the form.

here's a link to the requirements for the form of a marriage license in ky: http://www.lrc.ky.gov/statutes/statute.aspx?id=36475

generally, a deputy clerk can sign instead of the clerk, and i don't see that her name has to be printed on the form.

i *do* see, at the end of (3)(a), that the form has to provide a space for her name to be entered in. so the form itself can not have her name and she doesn't have to sign it; *but*, the deputy clerks have to write her name in when they complete the form.

if she's interfering with the deputy clerks filling in her name, then that would certainly be a problem. otherwise, i think it's technically legal.

the attorney for the county indicated that licenses issued when she was in jail were valid.

I just don't see the courts ultimately declaring the licenses currently being issued to be invalid.

If she can get more attention without much cost to herself, she might

Of course, she could be a genuine time-bomb, waiting to go off, no matter what happens

But her battery may be nearly drained, so there's no point in dribbling charge into it

Wait a week or two and see if she pops back into the national news on her own

lot of people are questioning her modification of official forms on her own. In fact any forms. I do wonder how much she has tampered with other forms in her office?

Some states listed husband/wife on official marriage forms for same sex couples, many clerks were concerned about that for same sex couples ... BUT, they did not go off on their own and change the forms/documentation.

To me, this clerk is way way over the line. Also, only one clerk in the office is now issuing the licenses. And he can't even sign his name, and the forms have been modified by her. He is concerned he is now on the hook for the legality of the forms, as he is the only one processing them. I don't blame him. Often the law works is strange ways.

Taking away gay marriage, same sex, religion and all of that and just looking at forms. IMO NO clerk should be changing on their own ANY official state form.

....of how much her co-workers HATE her and her son, Minion Davis. I can just imagine the eye-rolling and mocking that goes on behind her back every time she waddles through the office.

paper pushers, handing out documents and ensuring all of the information is valid and correct. And some are very knowledgeable about what is required and not. ... but, she is NOT the one that can modify documentation to her liking.

It is now the question of authority. She, IMO, feels she is more powerful and has more authority than SCOTUS and the Federal Judge. It is the breakdown of authority in this case that bothers me. Her god is not the final authority. If she were a Muslim, Buddhist, etc. they likely would have locked her up, the locals, and thrown away the key by now.

She is using her office to force her religion onto others. This, in the big picture, is a test case for establishing precedence. The Federal Judge certainly knows this. It is an attempt to try to continue to move this nation into a Taliban Christian Theocracy.

serve true justice, without giving her a lot of fanfare by her fans. My take on this is the judge should do what is needed to reprimand her. Otherwise, this is setting precedence for eroding the separation of church/state. I've heard she claimed her release from jail as a victory by her. IMO she is disgusting and needs to be removed, fined like hell, or tossed back into jail. Maybe all three. I had further elaborate on this post #20. I see this as very serious as do most of us.
