If federal marshals are required to arrest the Kentucky clerk how would the locals react to federal intervention? This standoff could get interesting. I realize that I am speculating and who would be responsible for carrying out sanction. I am sure the local community very likely supports her actions.

(16,082 posts)The matter of arresting her for contempt, was always federal...and not all the locals are on her side, some maybe...but it's a good bet that many of her supporters are not from the area!
She filed her original refusal in a federal court, it's up to the judge now!

(15,222 posts)No one is interfering with her right for her to have and exercise her own beliefs IN HER PERSONAL CAPACITY. But the duties of the job of County Clerk require that she issue marriage licenses, and if she is not willing to do this, she needs to get another job. She was well aware of the duties expected of her before she accepted the job (and yes, I know she was elected, but she shouldn't have run or taken the office if she couldn't do the job). It's time for her to be held in contempt, which is what she wants. Time to get this dog pony show on and OUT of the headlines. Put her in jail and put anyone else in that office in jail who temporarily takes her position if he/she refuses to perform the requirements of the job.

(6,324 posts)It's a matter in Federal court, so the contempt warrant will be one issued that US Marshalls enforce.
That's how it works- local LE doesn't have power to enforce Federal law.
