Kennedy Reading Majority.....four dissents to be read.....
HERE's THE OPINION...rests on Equal Protection and Fundamental Rights!!!
(2) The history of marriage is one of both continuity and change. Changes, such as the decline of arranged marriages and the abandonment of the law of coverture, have worked deep transformations in the structure of marriage, affecting aspects of marriage once viewed as essential. These new insights have strengthened, not weakened, the institution. Changed understandings of marriage are characteristic of a Nation where new dimensions of freedom become apparent to new generations.

(35,356 posts)And if marriage evolves and changes--presumably only in one direction--then you may have to wait for civil rights for polygamists for longer than 3 years, but there's no reason to think that there's any real moral principle that currently denies it won't be corrected.
Unless, of course, it's continued to be considered immoral, in which case the universe's moral arc continues to be ours. (That's sort of the problem with saying that our moral evolution is really a great, cosmic change towards ultimate justice. It confuses a small group of primates with some sort of anthropomorphized deistic universe. Not only are we the world, we are the deistic universe, lock, stock and barrel.)

(37,549 posts)both EP, and fundamental rights, I think Kennedy has opened the floodgates, legally.
I want to read more erudite commentators, but I think the legal worm has finally, irrevocably, turned.
