He hasn't filed a Statement of Candidacy (FEC Form 2) with the Federal Election Commission to register as a 2016 presidential candidate.

While this isn't something that's required to run for president, it is pretty much demanded by voters.

He'll have to bloviate from the sidelines though. If he doesn't file with the FEC, he won't be allowed to participate in the GOP debates no matter how well he's doing in the polls.
