It is obsolete as it stands.

Last thing we need is to open the door and set a precedent allowing the Repukes to start peeling back everything from free speech (First Amendment) to warrantless searches and seizures (Fourth Amendment) to treating prisoners like shit (Eighth Amendment), etc.

How about we deal with the terrorist assholes amongst us without stripping away everyone else's constitutional freedoms in the process?

We had enough of that shit with the Patriot Act.
