Representative Paul Ryan (R-WI) swore on Fox News Sunday that the GOP had a plan in place in case the Supreme Court eliminated the Affordable Care Acts federal subsidies, potentially stripping health care from at least six million people. He declined to say anything about that plan, however, and faced questions from an increasingly skeptical Chris Wallace.
...But when Wallace asked if that solution would allow those millions to keep theyre subsidies, Ryan deflected. Well, we will have a solution that addresses this law, Ryan said. Well have a solution for the people caught in this law, so that theyre not caught in the lurch. In response to several followup questions about the specificities of the GOP response, Ryan said he wanted to wait until the Court ruled before he said anything.
Wallace then challenged Ryans assertion that Obamacare was a failed law, noting it had insured 16 million people, covered swaths more with pre-existing conditions, and slowed the rise of health care costs, and noted the GOP had not proposed plans to replicate those successes.

For all the complaints, were five years into Obamacare and Republicans have still not come up with a coherent plan that will ensure that all of those millions of uninsured people will get coverage, Wallace said.

(11,175 posts)Dealing with an adverse SCOTUS decision would be simple -- a one-page bill that clarifies the language now in dispute and preserves subsidies for everyone. That's what some Democrats have called for.
At least one Republican counterproposal was to do that fix but to make it temporary. The subsidies would end very soon after the 2016 elections!
A confrontation could be coming if Republicans won't pass a permanent fix and Obama decides to play hardball and veto a "kick the can" fix. Then millions of people lose their subsidies and each party blames the other.

The GOP Knows after nearly 60 attempts to "kill Obamacare"...they'll take FULL Blame for Nearly 20 Million losing vital Health Care Services.

Good on Chris Wallace for not letting him get away with it. So often, even on other media outlets, the moderator let's Ryan spout his talking points without any push back. For Wallace to do this on FOX it's almost unprecedented.

(8,377 posts)There is a simple, almost trivial solution to this problem. The HHS can simply offer a services agreement to each of the states that uses healthcare.gov. The terms of that agreement would establish the state as the OPERATOR fo the system with HHS being the subcontractor that actually carries out the work.
That would solve the problem. It really isn't any more complicated than that. In fact, Pennsylvania has already been planning this exact thing.

The Obama administration has chosen to dare the SCOTUS to overturn the bill, hoeing that SCOTUS will chicken out. That way, Obama can claim victory.
The responsible thing would be to heavily publicize the contingency solution. That would effectively take the SCOTUS out of the equation. If SCOTUS knew that there would be a simple administrative work-around to their decree, they probably would not make a hostile ruling because that would just make them look silly. And if they did, it would not matter.
The big issue with the contingency plan is that it does require the Governors (and possibly the legislatures) to seek the subcontractor agreement and sign it. And that is even more reason why the Obama administration should be out there pushing this now, building political pressure on Jindal, and all the other governors who have dragged their feet. Please note the language about the Pennsylvania plan
