The King v Burwell SCOTUS vote was weeks ago. Are we to believe no one has leaked the result

to interested parties on one or both sides? No one in DC can keep their mouth shut, and there's no reason the Supreme Court is any different. So is there anything we can learn from what the President and various members of Congress have said recently? What about the stock prices of companies that would be helped or hurt? Presumably they'd really like to know in advance, and Congress is exempt from insider trading laws.

Anybody have some thoughts on this? If I had to guess, I'd say the ACA will be upheld, but my certainty level is barely above 50-50, and I'd sure hate to wager on it.

1. Thanks for your post. I have the impression it will not be upheld, but I could be very wrong.

I say that because a Republican is already starting to claim to have some alternative plan. Sounds like someone may have tipped Republicans off. I sure hope I am wrong.

But then this will be a good reason for Bernie Sanders to campaign for a single payer plan that cuts out a lot of the profit to insurance companies and the waste that insurance companies bring to our healthcare system if the Supreme Court does rule to end the subsidies and finish of Obamacare.

Someone should be talking to Baucus about how in the world the sloppy language got into the bill. He hovered over and dominated the writing of the bill. If it was not written carefully and correctly it is his fault.

The Republican I think you were talking about had a little smirk in his voice. At any rate, what I found startling, shouldn't have, but did was that 61% of the people who are going to lose their subsidy are white. 61% are from the south. Interesting statistics. I wonder how that will play out. A lot of my sisters relatives are staunch southern republicans who all signed up for Obamacare. Guess they will have to tell themselves they didn't deserve to have health insurance. TPM Josh Marshall has a good article. He bets they will uphold the law. We'll see.

4. I believe even this Court will have a hard time not recognizing Congressional intent. ACA upheld.

Look at the original ACA ruling where nobody knew and CNN reported based on the start of of the ruling that it was overturned.

slightly towards them upholding it, simply because it has been a boon to medical stocks. The industry wrote the thing. I can't believe I am saying this about the US Supreme Court.

7. I cannot, for the life of me, ever recall a SCOTUS decision being leaked as long as I have lived.

10. Given the structure and hierarchy of the court, only a clerk would be capable of leaking.

Whoever made such a leak would be easily discerned, too.

Thus, such a clerk's legal career would be over. Nofirm would ever hire. No court would ever hire.No prosecutor would ever hire. If they were lucky, they might be capable of being a public defender in some podunk town.
