In another salvo against the federal Affordable Care Act, some Republicans in West Virginias House of Delegates want to make it a crime for state and federal officials to enforce the health-care law.
Under the GOP-backed bill (HB2309), federal employees would face felony charges, while state workers would be arrested for a misdemeanor offense, if they try to administer any federal regulations under the Affordable Care Act. The legislation also declares the federal health-care law invalid in West Virginia.
Its one thing to oppose the Affordable Care Act, but its another thing to make it a criminal act for people to do their job, said Perry Bryant, who heads West Virginians for Affordable Health Care. This is really an extreme piece of legislation, as extreme as anything Ive seen this session.
The House Health and Human Resources Committee took up the bill Tuesday afternoon. In response to questions by House Democrats, the committees lawyer acknowledged it would be difficult and possibly unconstitutional to prosecute state and federal workers who administered ACA regulations. The attorney also agreed that the legislation could jeopardize health insurance for thousands of West Virginians.

Constitution? Repubs don't need no stinkin' constitution. As Balloon Juice says:
Considering all the collapsing coal mines and exploding oil trains in the state (plus whatever accidents Cole has slipping on ice and things) youd think that government providing low-cost health insurance would seem to be a good idea for a deadly state of death like West Virginia, but Black President.
Might be unconstitutional, because hey, whats a Supremacy Clause thing and the Civil War among friends, right? Go for it guys. West Virginia is like 94% white, guys. Exactly who are the shiftless, lazy Those People(tm) currently benefiting from Obamacare in the state, anyway?
