The ACLU of Nebraska has formed a panel of trial lawyers to help with potential prison litigation about “unconstitutional prison conditions.”

The move could be the first step in a lawsuit over prison overcrowding in Nebraska. Similar lawsuits have resulted in federal intervention in other states.

“If meaningful reforms are not enacted, we may use litigation to resolve the Eighth Amendment violations present in Nebraska’s prison system,” said Danielle Conrad, executive director of ACLU of Nebraska.

Nebraska’s prisons currently hover at about 159 percent of capacity. The governor can declare an emergency once prisons reach 140 percent of capacity.
