Alabama same-sex couples head back to court to fight for marriage licenses

MOBILE, Ala. — With many Alabama counties still refusing to issue marriage licenses to gay couples, the federal judge who overturned the state’s ban on same-sex marriages will hear arguments Thursday that could provide clarity to what has become a confusing, unsettled issue.

Three same-sex couples have asked U.S. District Judge Callie Granade to force Mobile County Probate Judge Don Davis to issue gay marriage licenses.

Davis, along with other probate judges, has refused to issue the licenses, saying Granade’s ruling last month conflicted with an order from Alabama Chief Justice Roy Moore, who declared that probate judges don’t have to hand out marriage licenses.

James Strawser and John Humphrey, one of the three couples in the Mobile case, walked hand in hand to the federal courthouse.

“It’s a great day for victory,” Humphrey said, smiling.

Would they just get over themselves and issue the dayum licenses! It's over you lost, I know it, you know it and the entire LGBT Nation knows it. So people like Davis should STFU, cause in Alabama LGBT PEOPLE CAN MARRY!!!

with full faith and credit (getting married in one state and moving to another state which should recognize your marriage) and ex post facto laws (laws which retroactively invalidate a gay marriage).

They need to stop fighting. When I was in law school nobody thought of gay people as a protected class that needed the right to be married. But the law changes and legal thinking changes.

He pointed out they had passed a statute making it illegal to pass any law based on any foreign religion. Where did Christianity spring from? Not here. Gotcha you closed minded super Holy Rollers!

On top of that they are losing, we've gone over the tipping point. It's all over but the shouting. Right behind it is pot. Give up and live with it all, it won't kill you.

And BTW, if you believe in the Bible you are violating some part of it to apply the part you want, typical.

One more generation of mostly old while males going bye bye (and maybe not going to where they thought they'd go) and this won't be an issue.

MOBILE, Ala. — A federal judge here ordered a county official in Mobile to issue marriage licenses to same-sex couples.

With the ruling, Judge Callie V.?S. Granade of Federal District Court, enjoined the probate judge in Mobile County, Don Davis, from refusing to issue licenses to gay couples seeking to wed.

“Judge Davis may not deny them a license on the ground that Plaintiffs constitute same-sex couples or because it is prohibited by the sanctity of marriage,” the decision said.

The ruling came shortly after Judge Granade heard arguments from lawyers for four same-sex couples seeking to marry and a plea for clarity from the lawyer of a local probate judge. The decision was expected to send a signal to judges statewide who are caught between a federal ruling and an order from Alabama’s chief justice.
