TMZ: photo shows Jenner was holding a cigarette, not a cell phone, at time of accident.

Of course the police are just beginning their investigation and have asked for the cell phones of all the drivers involved. So anything could happen. And, yes, every driver is responsible for not hitting the driver in front of him.

But people don't go to jail unless they are considered criminally negligent. And in a multiple-car accident, civil courts often find that the negligence is shared among multiple drivers.

In any case, pre-judging Jenner now on the basis of cell phone use isn't supported by any photo that's out there yet.

TMZ broke the story, the L.A. County Sheriff's Department was getting a search warrant to determine if Bruce was texting at the time of the collision ... but this picture would seem to make that unnecessary.

It's illegal to text while driving and motorists who do can be prosecuted for vehicular manslaughter if someone dies as a result.
Based on the evidence gathered so far, it seems Bruce will not face any sort of criminal prosecution. As we reported, he slammed on his brakes before impact and veered right to avoid the Lexus. And deputies believe a Prius in front of the Lexus may have made a sudden stop, triggering the collision.

of the investigation instead.

You must not have read the many posts here saying that Jenner is guilty and should be thrown into jail.

In my state we are required to leave 1 car length for every 10 mph behind the lead car. Freeway drivers violate this all the time so can be faulted for this.

And if this had been on ice you have to double the distance to be safe.

And especially if you are hauling something like a trailer, that makes it even more dangerous.

Actually, it's often impossible to follow since any "gaps" that a driver tries to leave in front of him will immediately filled by some other car.

You should keep two second between you and the car ahead of you (use a post or a tree to judge), then you add a second for every adverse driving condition like wet roads, darkness, etc. People in the middle of the country seem to do this better than those on the coast in my experience.

I escaped it in kindergarten, bless my autistic spectrum little kid self, always speaking my socially inappropriate own mind. And staring at very "important" people like they were nothing more than interesting insects.

Two of my siblings didn't drop out of the game until they had SAG cards and screen credits, in their twenties.

My brother played a rough cowboy or biker bar dude. He actually is a rough cowboy and biker bar dude, so the acting was easy. My sister played tough biker chick, cheerleader, or Malibu beach babe. She was also a Laker Girl.

My artist parents first met in the Hollywood industry.

My dad's mom and her sister ran away to Hollywood as young adults. They didn't much like the California Dairy business.

In my family we're still feeling the repercussions.

I clicked through to the Lakers Girls pics and one is named Hunter. And they all have long hair.

when an investigation has barely begun.

The day this happened people here immediately started the witch-hunt, calling for him to be thrown into jail -- even though we knew almost nothing about what happened.

Since then we've learned that driver he hit had suddenly stopped when she hit the car in front of her; that he passed sobriety tests; that the skid marks show he tried to stop; and that what was thought to be a cell phone in his hand was actually a cigarette.

Maybe it will turn out that he was negligent in an important way. But we don't know that now and I'd like to think people can learn from this. The details that immediately come out after any accident are usually garbled and confused. No one should be jumping to conclusions in the first days after an incident like this.
