The Brennan Center filed an amicus brief at the U.S. Supreme Court in Arizona State Legislature v. Arizona Independent Redistricting Commission. The case could drastically limit the ability of voters to enact redistricting reform. If the Arizona Legislature prevails, the decision could adversely affect the constitutionality of a whole host of laws passed by ballot initiative, from California’s open primary law to Oregon’s all-mail ballot elections. The brief argues that abolishing the commission would require a narrow reading of the term “legislature” that goes against both Founding-era usage and the history of the past two centuries.
