In a long-awaited ruling that will affect similar cases, a state appeals court ruled Thursday that a lower court properly dismissed citations against a participant in the daily noontime Solidarity Singalong at the state Capitol, because the rule that he violated was unconstitutional.
The decision by a three-judge panel of the state 4th District Court of Appeals will affect numerous cases involving dozens of people that have been in limbo, some of them also being heard by the appeals court, others still in awaiting decisions in Dane County Circuit Court.
This case involved a citation issued on July 24, 2013, to Singalong participant Michael Crute for participating in an unpermitted event. He challenged the state administrative code that imposed a permit requirement on gatherings of even small groups in public areas of state buildings, including the Capitol rotunda.
But Madison lawyer Robert Jambois, who has represented other Solidarity Singers who have been cited, said the Crute decision will affect cases he has pending in circuit court and many others, because judges have been waiting to see how the appeals court would rule in the Crute case......................

Its midday in the Wisconsin state capitol in Madison, and that means its time for a Solidarity Singalong. A circle of protesters have filled the central rotunda of the venerable building and are singing lustily to the tune of Ill Fly Away, their voices spiralling up into the dome overhead.
Were not going away, oh Scotty!
Until the day when justice holds sway.
You might think our mighty cause is lost, but

The singers arent here just for the harmonies they really mean it. They arent going away. Though their numbers are down to a meagre 15 from the thousands that overran the capitol at the height of Wisconsins union battles almost four years ago, they have stuck it out. Every weekday since 11 March 2011, without a break 1,006 days and counting they have turned out to sing songs of defiance against the man they call Scotty.
Thats Scott Walker, the governor of Wisconsin. His office is just a few paces from the rotunda and he must surely hear the chorus, though it doesnt seem to bother him. In his new book, Unintimidated, he recalls protesters chanting at him: Were still here!, to which he gives the dismissive riposte: Yes, but so am I..........
