Catholic school teacher claims she was fired over IVF
An Indiana teacher who was fired by a Catholic school is suing for discrimination, claiming she was dismissed for undergoing in vitro fertilization, which the Catholic church opposes, to try to get pregnant.
Emily Herx, 31, of Hoagland, says St. Vincent de Paul School in Fort Wayne violated her civil rights and discriminated against her because of infertility, which is considered a disability under the American Disabilities Act, according to a lawsuit filed Friday.
Herx, whose complaint was upheld by the Equal Employment Opportunity Commission, is seeking, among other things, compensatory damages as well as damages for mental anguish and emotional distress.
Herx had worked at the school for eight years but was fired in June after informing the school she was using sick days to undergo IVF treatments.
