Conflicts of interest in Douglas County make judge’s son eligible for Sarpy’s DUI diversion program

When Matthew Harmon was pulled over last summer in west Omaha, authorities said, his blood-alcohol level tested more than twice the legal limit, enough to get ticketed for aggravated drunken driving.

But because of the way his case was handled, Harmon will get benefits virtually unheard of for anyone else with such a serious drunken-driving case in Douglas County.

Those convicted of aggravated drunken driving in Douglas County’s system would end up with that black mark on their record and could receive at least a few days in jail.

Harmon, though, has entered Sarpy County’s unique diversion program designed for first-time offenders. If he completes it, Harmon faces no prospect of jail time and would emerge without a DUI conviction.
