60 votes in the Senate are only necessary to stop a fillibuster. Bills pass with a simple majority.

Republicans are not going to oppose this bill. I doubt they can get 41 Democrats to stop if from coming up for a vote. The real questions I see is whether it gets 66 votes, enough to over ride a Presidential Veto.
