But Kennedy is, at least, being a stickler for procedure.

At worst, he's been shopping for a case where he would feel comfortable ruling against marriage equality.

That's what scares me the most, because a ruling against marriage equality could invalidate every existing same sex marriage nationwide.

Do we believe the SCOTUS would do such a horrible thing?

How do you think our side won United States v. Windsor, in which the Supreme Court held that a key provision of the Defense of Marriage Act violated the Equal Protection Clause? It was a 5-4 decision in which the four liberals and the four arch-conservatives took their predictable positions. Kennedy is conservative but isn't as dogmatic as the four others, and in Windsor he sided with the liberals.

If it were clear that Kennedy would vote to uphold state bans, then the Supreme Court would probably have taken the appeals and reversed the circuit courts that overturned those bans.

All he's done here is to grant a stay. According to the linked article, Idaho has advanced some sort of argument trying to show that its case is different from the ones already decided. Kennedy is giving them the opportunity to press that position.

If Kennedy were a right-wing hack in the Scalito mold, DOMA would still be the law and there would be no federal protection for same-sex marriages.

This is a scene likely to be repeated in many states. It is one reason I'm not celebrating the USSC's non-ruling as much as some others are.

Way back in 1979.

Why? Because I was female and refused to change my name.

I asked him where it said in the Family Code I had to change my name and of course he had no answer. He had committed a misdemeanor by failing to carry out the duties of his office.



Not the same as gay marriage, but still bigoted bureaucrats.
