Florida Secretary of State: New congressional elections can't happen until 2015, and are 'illegal'

Florida Secretary of State Ken Detzner told a judge Friday that the state couldn't organize special elections to fill seven newly drawn congressional seats until March 2015 at the earliest.

But even that schedule "in all likelihood violates federal law requiring that members of Congress be elected on November 4, 2014, and serve two-year terms," lawyers for Detzner wrote in a court filing in Leon County Circuit Court.

Detzner wrote that March 17, 2015, was the earliest date the state and county election supervisors could hold a special primary election to fill the new congressional districts, with a May 26 general election to follow. But that would render this fall's elections largely moot.

Judge Terry Lewis has scheduled a hearing next Wednesday to decide whether to order special elections for the new districts, passed by the Florida Legislature on Monday.
