(18,585 posts)No, you'd have to convince (in this order): the cops, the DA/SA, possibly a grand jury, and possibly a jury, that a reasonable person faced with the same circumstances would fear death or grievous bodily injury.
In a situation such as the one you propose (and I assume no witnesses at all), and there exists no evidence of what he said nor your mad skillz evasion, then I think the police would laugh at you as they put you into the cruiser. It's not reasonable, and I'd expect the DA to agree.
