Family says 5 Oklahoma police beat father to death.

3 Oklahoma police officers were placed on administrative leave Saturday after a man whose ID they requested arrived dead and disfigured at a nearby hospital.

Two on duty Moore police, 1 off duty officer, and 2 off duty game wardens were involved in the beating.

He was beat to death in front of his wife and daughter.

The wife recorded the incident but the police confiscated her phone.

Another family member is said to have an audio recording.

The police are getting out of control or have been for awhile. They don't listen to anyone. Of course the guy should have just showed his ID to the police but even had he done that, the police never listen to the story and just make up what they believe happened. Most times, it is not even near the facts of the events.

I'm sure they'll give her back the phone with everything deleted.

If she can prove that stuff was deleted off the phone, she may be able to prove spoliation of evidence. A 10 minute video uses a lot of storage space. If those same data blocks in the memory have been scrubbed, there will be newer evidence of the scrubbing which occurred during the time the phone was not in her custody. Someone with access to the metadata of the filesystem in the phone could prove this fairly easily.

BUT she must not store any more information on the phone after it is returned, better yet don't even turn it on. Turn it over to her own forensic analyst immediately.

Seems like every day I see a story like this about law enforcement completely out of control. I'm sure there will be an "Internal Affairs Investigation". That's where the good ole boys go behind locked doors and put their heads together to come up with the most credible fairy tale of their version of what happened and why.
