Amanda Knox will refuse to return to Italy if she's falsely convicted again

Knox, 26, is facing the possible reinstatement of a hefty sentence for her alleged part in the death of the 21-year-old Leeds University student in Perugia in 2007. She and her co-defendant, Raffaele Sollecito, are in the final stretches of a second appeal against convictions handed down in 2009.

But the Seattle-based student, as is her right under Italian law, has not returned to Italy for the new proceedings at the Florence appeals court, saying she fears being found guilty and sent back to jail.

In an interview on Thursday, she appeared to confirm that she has no intention of returning to Italy if the verdict goes against her. Asked by the daily newspaper La Repubblica what she would do if her conviction were upheld, she was quoted as saying: "In that case I will be – how do you put it? – a fugitive."

If the court, which is expected to rule on 30 January, upholds the guilty verdicts its judgment will still have to be validated by Italy's supreme court. If that happens, Italy could request Knox's extradition from the US, a move her lawyers would challenge, at least in part on the US legal principle of double jeopardy – the premise that someone cannot be tried for a crime of which they have been acquitted.

The Daily Mail, which had been one of the worst perpetrators of yellow journalism against Amanda Knox and Raffaele Sollecito (falsely accused of the murder of Meredith Kercher), more recently published one of the best explanations of why the first appeals verdict was correct: both of them are clearly innocent. The crime is that they ever had to spend a day in prison.


The only thing that could be clearer in this article is that not only was there abundant physical evidence found in the murder room linked to Rudy Guede (including DNA and fingerprints in and on the body) -- but there wasn't a trace linked to Amanda.

The post-mortem could establish only a broad time frame for her death — between 8.55pm and 12.50am. There was also evidence of a burglary, since house keys, money, mobile phones and credit cards were missing and a rock had been thrown through the window of the adjoining room.

Further investigation of the crime scene revealed fingerprints, palm prints and semen that did not match any of the residents of the cottage. There was also a footprint of a Nike trainer in blood. Two witnesses had seen a young black man running down Via della Pergola from the direction of the cottage at 10.30pm. They said he nearly collided with them.

The black man seen running away might have been sought as a suspect if the police believed that an outsider had killed Meredith.

But within hours of finding the body, they concluded that all the evidence of burglary — the broken window, strewn clothing, missing belongings — had been staged to mislead them.

And the murder room, which was covered in blood and yielded dozens and dozens of pieces of physical evidence linked to the real murderer, Rudy Guede, contained not a single piece of evidence linked to Amanda.

Guede also left his DNA both inside and on the victim's body, and he had a recent history of carrying knives along in a string of burglaries.

The first appeals court verdict for innocence is the only possible one based on logic, reason, and law.
