The guy doesn't sound like a fool. Goldman Sachs has even more shit hidden, Greg Smith knows it. I suspect if Goldman goes after Smith he'll simply unleash the emails detailing the truly illegal stuff as well (beyond the moral scolding).

Discovery would be a monster.

Of course, GS could just build the world's largest shredder. It would take about 3 years of 24x7 shredding of papers & computer equipment to get rid of the evidence.
