Report Miscarriage In 24 Hrs Or Go To Jail For 12 Months. - VA. AG Candidate.

When will enough be enough for women. This AG candidate could win in Virginia. Will woman have to report illegal sex i.e. sex outside of marriage next. Why such candidates are not beaten by 30% is just impossible to understand. The lack of outrage by women and men of conscience is hard to understand. Such a candidate should be run out of the public forum.

All state consensual adult Sodomy laws were overturned by Lawrence v. Texas 2003.

That's one of the things that has Cuccinelli's shorts in such a bunch. He's demanding that Virginia be able to start rounding up everyone who has oral or anal sex.

The laws were nullified by the SCOTUS decision, which specifically said cops in Texas couldn't arrest gay people for having sex in their own home. Whether Texas did anything about the law or not is immaterial, because the court ruled all such laws unconstitutional.

I'm not a Lawyer, but that's my impression. I don't think any state anti-sodomy statutes against consenting adult private behavior, are valid anymore.

Otherwise, a cop could still cite that portion of the state code to justify an arrest. It would get dismissed by the court or DA but it can still cause trouble. That would be why I consider what Cooch is doing to be simply evil.

Many judges would toss a tort suit if the charges had been dismissed. "The system worked ya know." I lived in VA before and after the 2003 SCOTUS ruling, and still remember the debates. Conservatives refused to repeal the laws.

I think the last time it was used was around 1999. The fornication law had been very rarely enforced. It was last used I believe as leverage over some woman who was watching children for daycare.

I suggested when a bill criminalizing miscarriages in VA was being considered that every woman in VA should mail the man (of course) sponsoring the bill all their used pads and tampons so that he could inspect them personally for any sign of miscarriage since most happen within days of a scheduled period. The bill was withdrawn the next day.

However, the whole idea has not gone away as one fundy pol after another has proposed legislation criminalizing any woman who has had a miscarriage, no matter how early and whether or not she is aware one has taken place.

I would hope the good women of VA would do the research and find out which ignorant preacher is responsible for this monomania concerning miscarriages and expose him to ridicule.

Ridicule is the only thing that will throw these loons off their game and if they can find the source of this particular game, they have a chance of stopping it for good.

Under Obenshain’s bill, which was introduced in 2009,

When a fetal death occurs without medical attendance upon the mother at or after the delivery or abortion, the mother or someone acting on her behalf shall, within 24 hours, report the fetal death, location of the remains, and identity of the mother to the local or state police or sheriff’s department of the city or county where the fetal death occurred. No one shall remove, destroy, or otherwise dispose of any remains without the express authorization of law-enforcement officials or the medical examiner. Any person violating the provisions of this subsection shall be guilty of a Class 1 misdemeanor.

Our mother had to "gather it up" and take it with my sister to the doctor so they could see if her body had expelled it all.

It wasn't a baby, just a glob of bloody tissue. Never the less, my sister and her husband were devastated. This guy can go Rush himself. My guess is he is packing a gherken

Nothing about the identity of the father. Nice.

If he's trying to pretend a fetus is a person, and the wants the state to record a miscarriage the same way it does the death of a person, he's failing. When a person dies in VA, aren't the names of both parents recorded? Doesn't a fetal "person" have two parents as well?

Has he put forth any explanation as to exactly WHY he thinks this should be done?
