Just received this via email from the office of Lt. Gov. Peter Kinder:
Lieutenant Governor Peter Kinder today released the following statement urging Missouri Attorney General Chris Koster and the Nodaway County Prosecuting Attorney Robert Rice revisit a controversial alleged rape case in Nodaway County.

“Since Sunday I have read with growing dismay the media accounts of the Daisy Coleman case in Nodaway County. I make no claim to knowledge of all the facts. Still, facts revealed in exhaustive media reports, including the 4,000-word piece in the Kansas City Star, raise all kinds of questions that it is now clear won’t be put to rest. These questions will fester and taint the reputation of our state for delivering impartial justice to all.

“I am disappointed that the Attorney General would wash his hands of the matter through a brief statement by a spokesman. The appalling facts in the public record shock the conscience and cry out that responsible authorities must take another look. I call on Attorney General Koster and Prosecutor Rice to join me in asking that the Circuit Court convene a grand jury to review all the evidence, hear all witnesses, and issue a decision as to whether charges should ensue.

“I hope that responsible officials will join me in this call for a grand jury to make the final call on whether criminal charges should or should not be filed.”

The state statute reference by Jones says:

The attorney general shall institute, in the name and on the behalf of the state, all civil suits and other proceedings at law or in equity requisite or necessary to protect the rights and interests of the state, and enforce any and all rights, interests or claims against any and all persons, firms or corporations in whatever court or jurisdiction such action may be necessary; and he may also appear and interplead, answer or defend, in any proceeding or tribunal in which the state’s interests are involved.

Koster has made the statement that, due to Missouri law, he technically cannot enter into the fray unless asked. He also said that maybe there needs to be a bill presented and passed that allows him to enter in a manner that will not be fought in court further down the line.

I've met Koster on a few occasions, back when he was the lead prosecutor for Cass County. He can be a jerk but in cases like this he doesn't back down and he had a pretty good success rate of conviction. In his case, it's not because of the politics or connections but because of the way the law is actually written.

As to Jones making his comment, it's a fight between Republicans and Democrats. Jones is proudly a member of ALEC (and a birther) who will use this to his advantage, no matter what Koster does. If Koster waits to see what happens, he'll blame him for the mess. If he jumps in he'll find a way to cite law stating that he cannot jump in on this case and that the "damn Dems" are rewriting the laws.

BTW-it's also rumored that Jones might be eying the state AG job so of course he'll put this out there.
