Retired dentist stands trial in West Boca Raton road rage shooting

Like so many road rage incidents, this one started with a perceived traffic slight, a few horn honks, and an angry gesture.
But this confrontation ended with flashes of gunfire and two injured people when a motorist fired four shots from his .357 Smith & Wesson revolver at a West Boca intersection.
Now a Palm Beach County jury will decide if Wayne Tover used his handgun in a justifiable act of self-defense, or if the Sept. 18, 2010, incident on Glades Road was a violent crime punishable by up to life in prison

"He was in his own car minding his business and he had an absolute right to defend himself," attorney Richard Lubin said in his opening statements. He said Tover was licensed to carry the "snub nose" pistol, for protection, and it was a good thing because of an "extremely violent young man" in the other car.

Though some facts are in dispute, the sides agree that Tover, the suspected shooter, was driving his silver Cadillac XLR convertible with the top down shortly after 8:30 p.m. when he pulled in front of a black Hyundai Accent with four occupants heading north on Judge Winikoff Road.

The Hyundai driver, Alexandra Nisallo, now 21, said Tover was going too slow so she honked at him three times. Tover came to a complete stop just ahead, opened his door, and began to step out of his car, Nisallo said during testimony.
After Nisallo hit the brakes, she then drove around and past Tover, and her then-boyfriend, Nicholas Perriello, made a gesture with his arms, Papero said. Nisallo's younger sister Angela, now 19, and friend Christopher Romano were in the back seat.
In Lubin's account, Perriello "is in the window screaming, yelling and cursing at [Tover] in a threatening way."
Nisallo then made a right turn from Winikoff to Glades Road, and headed east toward a Publix. Minutes later, Nisallo was stopped in the left lane at a red light at the Diego Drive intersection, when Tover pulled alongside her in the right lane.
What happened next is the heart of the dispute. The prosecutor said Tover immediately starting firing, and Nisallo testified she was startled by the shots.
While her sister called 911, Alexandra Nisallo drove to West Boca Medical Center. Perriello, now 23, was treated for bullet wounds in his right arm and upper chest, and Romano, 19, was cut on his arms by shattered glass

(25,592 posts)Make them think twice about carrying a gun in public. If you use it, you lose it, until it is determined you needed it to thwart a life threatening situation. Sounds sane to me.

(37,332 posts)Florida self-defense. These people were obviously on Tover's personal road and if that wasn't an insult enough they were driving a Hyundai. A fuckin Hyundai! These people should be kissing his ass and thanking him for not having an RPG or at least a 1911 with a extended magazine and being a crack shot! Tover obviously fucked up because he missed killing some innocent by-standers too. His lawyer should demand the county pay for some arms training so that next time he feels slighted he can at least hit more people.
