Anti-surveillance state activist already faces 100 years—now prosecutors want to silence him as well.

Federal prosecutors will attempt to place a gag order on the jailed activist-journalist Barrett Brown and his legal team on Wednesday that would prevent them from talking to the media about his prosecution.

The US attorney Sarah Saldana will call on the federal court for the northern district of Texas, in Dallas, to impose a stringent gagging order on Brown and his lawyers. Brown faces up to 100 years in prison for alleged offences relating to his work exposing online surveillance.

In legal papers lodged with the court last month, the government asked the judge to instruct the defence to refrain from making "any statement to members of any television, radio, newspaper, magazine, internet(including, but not limited to, bloggers), or other media organization about this case".

Media observers will be watching the hearing closely as it is widely seen as the latest in a succession of prosecutorial moves under the Obama administration to crack down on investigative journalism, official leaking, hacking and online activism.

Brown's lead defence attorney, Ahmed Ghappour, has countered in court filings, the most recent of which was lodged with the court Wednesday, that the government's request for a gag order is unfounded as it is based on false accusations and misrepresentations. The lawyer says the attempt to impose a gagging order is a breach of Brown's First Amendment rights as an author who continues to write from his prison cell on issues unconnected to his own case for the Guardian and other media outlets.

I guess this puts the lie to the oft repeated "advice" for Snowden to
"just come back and face the music" in the "fair" US Judicial system.

A federal court approved a media gag-order on Wednesday preventing imprisoned writer-turned-hacktivist Barrett Brown and his attorneys from speaking to the media about their case. . . .

The court’s ruling on Wednesday acknowledged that the case “has generated extensive local publicity in both the print and broadcast media, as well as the social media,” and claimed, “This pervasive publicity can be expected to continue during the pendency of these criminal actions.”

As a result, the court ruled, “it is necessary for the court to take limited steps to restrain Counsel and Defendant from making prejudicial statements to the press and media.”

The gag-order mandates that neither Brown nor his counsel shall make any statements to the media “that could interfere with a fair trial.” All comments must be restricted to those already in the public record, without elaboration of characterization.

When federal agents raided local hacktivist Barrett Brown's apartment last fall, throwing him in prison for what could wind up being the rest of his life, they succeeded in shutting him up for about a day. Soon, however, he was scribbling letters from prison claiming the FBI had broken his ribs, penning articles for Vice, and giving interviews to Rolling Stone.

The government was not happy about this, accusing Brown of attempting to "try the case in the media" and demanding that he be forced to stop.

As recently as this morning, in the hours before a judge was scheduled to decide whether to put a gag order on all parties, Brown's attorneys argued vociferously against the measure, leading one to expect fireworks at today's hearing.

Instead, Brown's attorneys and prosecutors agreed to stop talking to the media, "including, but not limited to, bloggers" about the case since it "could interfere with a fair trial." Brown will still be aloud to hold forth on other, unrelated topics.

That's what makes me sick. We voted these people in, but we sure didn't get what we thought we were voting for, in most cases. I had already seen the weaseling on social security and in prosecuting medical marijuana use where it was legal, but this iron fisted response to folks outing their illegal spying is appalling.

to stifle comment they are worried about....fitz had no problem releasing the incriminating tapes on rod b when they arrested him....effectively "trying " him in the media
