Bank Repossesses Wrong House, Sells Off Homeowner's Stuff (tells owner to piss up rope)

The thing that still stuns me is, they don't fucking care. "Yeah, we fucked up hugely, and took your stuff. So what? Piss off, we've got better things to do than make it right."

Barnett suspected she had been robbed — and she wasn't too far off.

It seems that, while Barnett was gone, the First National Bank of Wellston arrived at her place of residence, broke in, and took possession of all her belongings, including the house.

Except, as it later turned out, they had the wrong address.

"They told me that the GPS led them to my house," Barnett told 10TV. "My grass hadn’t been mowed and they just assumed."

Phoning the local police to report the incident did Barnett little good, as the McArthur Police Chief refused to investigate and considered the case closed.

But for Barnett, the ordeal is very much ongoing.

With all of her stuff either sold off by the bank or thrashed, the homeowner presented the bank's president with an $18,000 estimate for restitution.

He refused to pay up.

"He got very firm with me and said, ‘We’re not paying you retail here, that’s just the way it is,’" Barnett recalled. "I did not tell them to come in my house and make me an offer. They took my stuff and I want it back."

The bank's president claims he is trying to "come to terms" with Barnett, but she denies this.

"I’m getting attitude from them," she said. "They’re sarcastic when they talk to me. They make it sound like I’m trying to rip the bank off. All I want is my stuff back."

an obvious crime? This is felony theft.

That an individual must now seek and pay for justice when a crime has been committed against them.

This is what we have come to. Seek what ever justice you can afford.

Please point to where I made that statement.

I can hold two, even more, thoughts in my head. If you want to discuss that end of it, we can.

Try looking at a situation from more than a single angle sometime, and stop accusing people of saying things they did not say. It makes you look like a goader.

I asked for clarification of your statement. You're not the only one here that can hold two or more thoughts in their head at once.

I don't think I'm the goader here.

I think she should sue the police, too--and she's going to HAVE to do that, because the chief of police decided to not investigate. She could try the attorney general, but I wouldn't hold my breath.

A lawyer who is skilled in this sort of thing, who will do the job for a percentage of the cut, is needed in this situation.

a good lawyer can make them regret not taking that $18,000 settlement offer. I'm trying to remember my business law class but the tort of conversion offers more than just restitution for the possessions.

Maybe they can sue that police chief, too, and get a nice payday from that town--who hopefully will throw that dumbass out on his ear...

This is breaking and entering, grand larceny, trespassing, and a couple of other crimes.

Sounds like corruption at multiple levels.

...wanting to represent a slam-dunk case like that. The bank will be wishing they had accepted her first offer.
