He just, to me, comes across as a smug & condescending. Maybe I'm wrong, but them not acknowledging the gravity and tragedy that a 17 year old ended up dead seems tone deaf. You can do that and still claim Zimmerman was acting in self defense. But the tone is just wildly off putting to me.

Public sidewalk, built with public funds and maintainted/repaired with public funds. Funds from the Public Works Department which is always bolstered by property taxes (permissing to collect taxes given by the Feds) and Public Works budgets always bolstered by grants and subsidies given by the Feds. Doesn't matter that the sidewalk was created during the Bush administration, it's alive and well and fuinctioning as a social contract under Obama. Did O'mara clarify that that?

and maintained by HOA assessments. IF you look at it the sidewalk is not a part of any public easement but is on HOA property between HOA buildings:

Where someone is alleged to have engaged in an assault with a deadly weapon and the injury involved hitting someone's head against the floor or sidewalk, the courts have divided, often based on the specific language of the statute in question, on whether the floor or sidewalk can constitute a deadly weapon.

To put it another context, UVa lacrosse player George Huguely killed his girlfriend Yeardley Love by slamming her head against a wall. If after the first time he slammed her against the wall she had broken free, grabbed a gun and shot him, would she be justified in claiming self defense?

My point isn't that Zimmerman should get off based on self-defense (I don't think on the facts of this case he should); its merely that its not really a stupid argument, its an argument that is being made in stupid terms.
