Supremes: Affirmative Action in Schools upheld

Breaking now. No doubt the full story and background will unfold quickly. I will not be following this, so others might wish to post updates. The ruling was about University of Texas and was apparently quite narrow.

The lower court granted summary judgment (meaning it never went to trial). The Supreme Court said granting summary judgment was improper, so it goes back down to the lower court for a full review (or conceivably for a new summary judgment using strict scrutiny).

They upheld it but said universities must show that no race neutral alternative exists before they can invoke affirmative action.

Just saw the ABC special report.

They punted it back and did not uphold anything.
