Police believe this is a tragic accident and do not expect charges to be filed.

GENEVA, Ind. -- A 12-year-old boy who was accidentally shot by his brother in their Jennings County home has died.

Major Jerry Shepherd, with the Jennings County Sheriff's Department, said, "officers found a 12-year-old child shot once in the head, shot by his 16-year-old brother."

Major Shepherd said the older brother was moving a .22 caliber rifle when it suddenly went off around 11:30 Monday night, while their parents were sleeping, striking 12-year-old Seth Box.
