Area prosecutors not enforcing gun law

Area state's attorneys say they tend not to prosecute people who violate the state's concealed carry law — if they aren't otherwise breaking the law.

"We normally have not prosecuted concealed carry cases as long as the person is not acting like a jerk," said Effingham County State's Attorney Bryan Kibler. "We don't want an otherwise law-abiding citizen to have a criminal record for carrying a firearm."

Several Illinois state's attorneys have publicly announced they would not enforce existing state law on concealed weapons because of a recent federal court ruling that claims the ban is unconstitutional. But Kibler said prosecutors, especially downstate, have been using prosecutorial discretion to ignore the law for some time.

"I don't think this is anything new," he said.

What is frustrating some prosecutors around the state is that we are now 3 business days over the original deadline for the CC law. The governor appears to be dragging his feet, while these prosecutors face the possibility of charging and trying people for CC, which could, technically, now be OK in Illinois. They are in a state of limbo. What's more, should they arrest someone on CC charges, they run a big risk of legal action against their offices for improper arrest, malicious prosecution, etc.

All this prosecutor and an additional one have done is state that they will not be left in limbo and will not spend money arresting and jailing people for doing something that may not really be against the law in this state anymore.


I can see where the reluctance to prosecute, Gov. Quinn needs to either veto, which will be overridden, or sign the bill into law.

...once they tear down the school. I know they're going to tear it down, it's in the budget to build a new one across town.

It's unfair for me to get a ticket for speeding past these kids! The law will change any day now!
