New federal court filings allege that legislative aides appear to have deleted “hundreds of thousands” of files at “suspicious times” from state computers used by Republicans in redistricting.

Finding that “fraud, misrepresentation or misconduct” likely occurred, the judges ordered a post-trial investigation into the missing records. In February, the panel ordered the state to turn over three redistricting computers that had been housed at the Madison office of the Michael, Best and Friedrich law firm.

In their filings Thursday, the plaintiffs said the investigation by forensic expert Mark Lanterman and his Minnetonka, Minn.-based company, Computer Forensic Services Inc., had detected thousands of files deleted by someone signed on with the user names of legislative aides Tad Ottman and Adam Foltz. Emails sent to Ottman and Foltz were not returned Friday.

According to the filing, the first deletions came Jan. 6, 2012, just after attorneys for the state were ordered by the panel to turn over additional records in the case. The second deletions, on July 25, 2012, were made days after control of the Senate shifted to the Democrats as a result of recall elections in July 2012. (Republicans have since regained the majority in the Senate.)

Tad Ottman and Adam Foltz, Republican aides who drew the redistricting maps testify at the public hearing in July. We recently found out that Adam Foltz wrote a secret talking points memo for Robin Vos telling Republican legislators to "ignore the public comments" about the maps. We also found out that Adam had almost all of the republican lawmakers sign non-disclosure agreements about every part of the map making process.

These two taxpayer aides actually work out of the office of the law firm hired to represent the Assembly Republicans even well after the drafting of the maps has been completed.
