so I just heard on the news that the Boston bomber. .

has not been mirandized and there is a questionat least according to the news, of whether or not he will receive a trial or be treated as an enemy combatant.
I am curious of others opinion on this subject.
My feelings on this are that given the fact that he is a citizen of our country he deserves the right to a trial!
There is certainly no doubt of their guilt since they fired on police.however that does not preclude his rights as a citizen of the US.
If he is treated as a combatant then he will be sent to gitmo. I feel that justice would not be served. He commited a crime against the people and the people deserve to decide his fate
Also if he as an American is held without benefit of trial then any of us could as well.

He can join the dozens of hunger strikers, many of whom will die!

Seriously though, my feeling is that suggesting a trip to Gitmo is just McCain ass-hattery!

There is nothing to be gained by bringing Gitmo into the news more than it already is....

There will be a civilian trial. (And the Miranda Right "safety waiver" is thoroughly constitutional since 1980, and with much precedent.)

You're just hearing noise and b.s from the media who are too empty of imagination to come up with anything better to do than throw around stupid ideas raised by the likes of Lindsey Graham - ideas that if looked at with any sense of history, are shown to be completely idiotic and extremely unlikely to be pursued by any president, let alone Obama.

As to the Miranda delay, that option exists for the purpose of obtaining information crucial to public safety. The fact that he isn't Mirandized when he gives any info in that period, will make it difficult or impossible for that information to be used against him in court. But the case against him is so strong without him saying a word anyway, why not try to get any info that might protect the public from other bombs that were planted, or other potential bombers in his group?
