(3,702 posts)this is the exception to Miranda before questioning him. I can see this if they are asking him if they are any other explosive devices they need to know about. If he says "yes, such and such device is XYZ Street" later on that cannot be thrown out as evidence because of the exception
He will be Mirandized later for sure

(62,444 posts)If he isn't Mirandized, then any statement or confession he makes during custodial interrogation can be deemed inadmissible.
That has nothing to do with whether there is sufficient evidence to obtain a conviction which does not rely on any statement made in custody.

And if the guy confesses, you want that in evidence if at all possible.
Just saying it's better for the state's case.
